1. Fundamentals of the Contract

Subject of Business

KiezForm is an innovative blockchain-based certification system for 3D-printed jewelry. The main subject of the contract is the acquisition of a digital ownership certificate that is registered in our secure blockchain.

The physical jewelry piece is delivered as a free addition to the digital certificate. The value lies in the unique, tamper-proof blockchain registration and the associated proof of ownership.

2. Scope of Services

Digital Ownership Certificate (Main Service)

You acquire a unique, tamper-proof digital certificate that includes the following services:

• Blockchain Registration: Immutable proof of ownership in our KiezForm blockchain
• 3D-Printed QR Code: Physical proof of authenticity, integrated into the jewelry piece
• Digital Transfer QR Code: Enables secure ownership transfers
• Verification System: Online authenticity check via our platform
• Blockchain Explorer Access: Transparent insight into all transactions

Jewelry Piece (Free Addition)

The physical jewelry piece is delivered as a free addition to the digital certificate. It is high-quality 3D-printed jewelry made from premium materials, however the digital certificate is the focus of the contract.

3. Prices and Payment

Pricing

The stated price refers to the digital ownership certificate including all blockchain services. The physical jewelry piece is included free of charge.

All prices are final prices and include the statutory value-added tax.

Payment Terms

Payment is made before creation of the digital certificate. After receipt of payment, your certificate will be registered in the blockchain and the jewelry piece will be shipped as an addition.

4. Delivery and Fulfillment

Digital Services

The digital certificate will be registered in the blockchain within 24 hours after receipt of payment. You will receive an email with your access links and QR codes.

Physical Delivery

The jewelry piece as a free addition will be shipped within 3-7 business days. Delivery is exclusively within Germany.

5. Right of Withdrawal

14-Day Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of contract conclusion.

Exclusion of the Right of Withdrawal

The right of withdrawal expires for digital content if execution has begun with your express consent before the end of the withdrawal period. This occurs as soon as the digital certificate has been registered in the blockchain.

6. Warranty and Liability

Warranty for Digital Services

For the digital certificate, we guarantee:

• Flawless functionality of the verification system
• Permanent access to blockchain registration
• Functionality of QR code systems

Limitation of Liability

For the free addition (jewelry piece), we are only liable for gross negligence or intent. Warranty for wear and tear or normal signs of use is excluded.

7. Blockchain and Data Security

Blockchain Technology

Your digital certificate is stored in our secure, SHA-256-based blockchain. This technology ensures the immutability and tamper-proof nature of your proof of ownership.

Data Protection in the Blockchain

Only pseudonymized data is stored in the blockchain. Your personal data is protected by an anonymous owner code (USR-XXXXXXXX).

8. Transfer of Certificates

Transfer System

You can transfer your digital certificate to other persons at any time via our transfer system. Every transfer is automatically documented in the blockchain.

Transfer Costs

The first transfer of your certificate is free of charge. Minor processing fees may apply for additional transfers.

9. Special Provisions

Loss of the Physical Jewelry Piece

Since the jewelry piece is merely a free addition, its loss does not affect your digital ownership certificate. The certificate remains in the blockchain and can still be verified and transferred.

Technical Development

We reserve the right to continuously improve our system. Existing certificates always remain valid and accessible.

10. Final Provisions

Applicable Law

Exclusively German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

Place of Jurisdiction

The place of jurisdiction for all disputes is Berlin, provided you are a merchant, legal entity under public law, or special fund under public law.

Severability Clause

Should individual provisions of these terms of service be or become invalid, the validity of the remaining provisions remains unaffected.
